These terms apply to murconsafetysolutions.co.uk and this client portal, operated by Murcon Safety Solutions (“Murcon”, “we”, “us” or “our”).
By using the website or portal you agree to these terms. If you do not agree, please do not use them.
A separate contract may also apply where we provide paid health and safety services. If there is a conflict, that service contract takes priority for the services it covers.
1. Using this website
The website is provided for general information about Murcon and our services. We take care over the content, but it is not a substitute for specific advice about your business.
You must not misuse the website, attempt to gain unauthorised access, or use it in a way that is unlawful or harmful.
2. Enquiries
Sending an enquiry does not create a contract for our services. We will confirm in writing if we agree to work with you, including fees and scope where relevant.
3. Client portal
The portal is for authorised users of businesses that Murcon has invited. You must:
- keep your login details confidential and not share them
- tell us promptly if you think someone else has used your account
- only upload information and files that you are entitled to share
- use the portal only for your organisation’s legitimate health and safety needs
We may suspend or close an account if these terms are broken, if a client engagement ends, or if we need to protect the service.
Documents in the portal are provided for your organisation’s internal use in connection with our services. You must not publish them, sell them or pass them to third parties except where the law requires it or we have agreed in writing.
4. Health and safety responsibilities
You remain responsible for complying with health and safety law that applies to your business, including the Health and Safety at Work etc. Act 1974 and related regulations.
Advice, documents and portal content we provide are based on the information available to us at the time. They do not transfer your legal duties to Murcon, and they are not a guarantee that an incident will not occur.
5. Files and requests
You are responsible for the content of files and requests you submit. Do not upload material that is unlawful, confidential to someone else without permission, or that contains viruses or other harmful code.
6. Availability
We aim to keep the website and portal available, but we do not guarantee uninterrupted access. We may update, suspend or withdraw parts of the service for maintenance, security or other operational reasons.
7. Intellectual property
The website design, branding, text and materials we create remain owned by Murcon or our licensors, unless a service contract says otherwise. You may view and print pages for your own internal business use.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
The website is provided free of charge and, to the extent permitted by law, without warranties. We are not liable for loss that was not reasonably foreseeable, or for loss of profit, business, data or goodwill arising from use of the website.
Liability for paid services is as set out in the relevant service contract. If no such contract applies, our total liability arising from use of the portal is limited to the fees paid to us for the services to which the claim relates in the 12 months before the claim.
9. Privacy
How we use personal information is explained in our privacy policy.
10. Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that we may take action in another jurisdiction to protect our rights.
